Default Really Confused...

I've asked a few other people that visit NZ emigrating sites but I'm even more confused.

I just want to check that I am reading this right.

From: New Zealand Work Visa Talent (Accredited Employers)


full time (on average, at least 30 hours a week)
for at least two years
with an annual base salary of at least NZ$50,000 (gross)
in the employer’s main business activity, and where they are directly responsible for your output.


You either have to work 30 hours a week OR make $50,000. RIght?
It's impossible for my daughter or my partner to make $50,000. I am one level below Senior Accountant and the job agency's we visited in Wellington said I could expect $35,000 to $40,000. They know that I will be needing a work visa.

Also, to apply for PR under the Skilled Migrant (including my partner and daughter) - my daughter needs to be totally or partically reliant on an adult. How there a limit to how much she can earn before she becomes non reliant?

We arrive in NZ in 35 days!

Apologies if I've missed something from another post, but is there any reason you need the Talent visa and not just a standard work permit?

I guess this would be under the WTR category where all these rules apply. An ordinary WP wouldn't lead to PR unless it was used to gain points for NZ employment for a later PR application.

Janmommy, the ruling regarding the 30 hours is that you must work at least 30 hours per week AND earn a minimum salary of NZ$50,000 whilst doing it. The level went up not that long ago.

The Operations Manual isn't very helpful with regard to assessing how much a depedant child can earn. This is what it says about it in relation to a PR application. You need to be psychic to know what 'substantially reliant' means. It looks like it's up to the individual officer to determine how it goes.

For the purpose of lodging an application, and despite the definition in section 2 of the Immigration Act 1987, a child is dependent if he or she is:

aged 17 to 24, with no child(ren) of his or her own, and
single*, and
totally or substantially reliant on the principal applicant* and/or the principal applicant's* spouse or partner for financial support, whether living with them or not; or

aged 16 or younger, and
single*, and
totally or substantially reliant on the principal applicant* and/or the principal applicant's* spouse or partner for financial support, whether living with them or not.
When determining whether a child of 17 to 24 years of age is totally or substantially reliant on the principal applicant* and/or the principal applicant's* spouse or partner for financial support, visa and immigration officers must consider the whole application, taking into account all relevant factors including:
whether the child is in paid employment, whether this is full time or part time, and its duration;
whether the child has any other independent means of financial support;
whether the child is living with its parents or another family member, and the extent to which other support is provided;
whether the child is studying, and whether this is full time or part time
.


If no one in your family is eligible to apply under the SMC because there aren't enough points, you could maybe make up your points by getting a job offer and gaining NZ work experience via a temporary WP and then applying for PR later.

we don't have enough points to apply for the PR without a job offer. and i can't seem to get a job while we are outside nz.

What a lot of people do in that situation is to go to NZ on Visit Visas and look for work while they are there. It's not recommend to mention that you will be looking for work when you enter the country as immigration frown on 'holidaymakers' looking for work. It can be very difficult finding a job from outside of NZ with potential employers being rather reluctant to take on someone they have never met or who might never go the whole hog and immigrate. However, there are some stubborn employers who insist that you have a Work Permit before they can offer you a job, but the reality is that you need a job offer to apply for a WP in the first place.
