Default When you think its all going well, why does something always ruin things ?

Hubby came in on friday and announced his company are now not renewing his contract, well they can but the hours will drop to part time or casual.
They said this to all the guys who had trial period
Its their way, that by doing 3 month contracts, they can cover their own backs incase of work shortage, and dont have to give anyone sick pay.holidays etc
Which is a bummer to us,as his work permit is made out to the company, and for 2 yrs
Might not be any work in 3 months,so cant see it going for 2 yrs
Right now Aluminium joiner is on ltss list and with 2 yrs experience, what we had planned for,to apply for pr,in 2 yrs time
His other trade, solid plasterer is in ltss but requires level 4 ,which he doesnt have, but did have 2 yrs experience at this
Im getting bit worried now,as starting to feel settled as im enjoying my wee job,and kids settling nicely(well teen would go back tomorrow if had chance)
Its maddening as only the other week the boss is saying to him,oh dont worry about work, theres plenty to come
The only other thing is,they gave Colin a contract to give immigration, saying he had job for a year
After Colin gets the permit, they said he was on a 3 month probation ,but no worries, just formality
Can he now pull out, would immigration not blame him,as its him not keeping to his end of deal, not Colin
Has anybody else came across this kind thing?

Don't ya just love it when that happens!

Very sorry to hear that news, Meadow, but sounds like a trick I've heard of before in the UK where an employer could get rid of someone easily as long as they hadn't worked there for more than 2 years. It seems employees' rights change once they've worked those 2 years. It must be 3 months in NZ. If the employer is accredited, he should be reported for dishonourable behaviour.

If Colin could find another job, still using his skills that INZ wants, he could apply for a Variation of Conditions on his WP. It says:

have been employed in New Zealand during the currency of that visa or permit for a period of 24 months by an accredited employer (or another employer if you were granted a Variation of Conditions to your work permit by Immigration New Zealand)

From here. I just grabbed a section from this page as I don't remember the full circumstances of Colin's visa situation. Perhaps you can read through to check this is right for him.

Good luck. I hope he can find a more secure position with another company without too much trouble.

What a bummer Meadow. As MB says it would be worth tryong for a variation. As he has skills on the LTSSL he should be able to find another job soon - do you have enough points without a job to apply for PR?

Hey meadow. Already spoken to you about it but just thinking. If Colin can get another Job offer can you not apply for PR (or do you not have the points without the experience)?
I know that might mean going through medicals again but at least you would feel more secure and Colin wouldn't be tied to just one employer for all that time.

Default Thanks guys

For the replys
Colin texed me this morning
He spoke to boss and showed him the work permit, stating the company name etc
Colin also reminded him of the first contract they gave him, that he gave to immigration ,stating employment for a year
He then says' oh theres plenty of work, just a wee dry patch there'
Aye right, just gave me atotal head nipping weekend, worrying that this is all for nothing.
Colin reckons the boss guy is actually alright,As he has got on well with him from start, and couldnt get away with how easy going and laid back he was.
But he has an interfering son,who doesnt have a clue, and the sons trying to do things his way,and its not the right way either
I think its a shoddy business tbh,and if they keep messing staff around, then its heading to being bust soon
But if we could just stall things just now,and that way can then get onto immagration,as they are really helpful over the phone, and see what we can come up with.
The aluminuim joiner has to have 2 yrs experience,Colin only has 3 months so far
and the solid plasterer, used to be 2 yrs experience,or certificates
now its just the certs. He has the 2 yrs
I was hoping if he could even just get a job offer in this trade, then start the ball rolling from there, but now its the certs
I know these things keep changing,so gonna just have to keep an eye on the lists
We have no other quals to use
I would love now just to start going for pr,as this is too nerve racking, wondering are you here for good or not
And that way he could then go self employed, doing plastereing and not have to rely on a company,as the same thing happened in Glasgow
Building trade jobs are a pain in the butt

Isn't that just typical. He'd have been fine if only they'd left things as they were. Funny how just work experience was good enough then, but it isn't now .

Yeah MB it sure is.
And half the time im not sure if im getting it right or not anyway
Good thing is will find out on friday what sort of contract they are giving him again.
We wouldnt mind sticking out for the 2 yrs experience(alu joiner job),as long as the employer just now, keeps him there
But if its not meant to be,then something better might be ahead for us.
Got to keep thinking along those lines ,keep me sane

Meadow, just keep believing all will be well and all will be well. If you worry about it and imagine it getting worse, it will get worse. Believe that it is just alittle blip and envisage yourselves getting over it with PR in tow and it will all come good. Trust me. I am a vair wise, flip flop wearing hippy who talks with the spirits as well as drinking them and I know that NZ wants you to stay
