    Default Stay in NZ while processing ITA?

    Hi Guys!

    I have been in NZ on work permits for 2.5 years and the current one expires in September. I have submitted my EOI in the skilled migrant category, but I am worried about the processing time. Does anyone know if I can stay in NZ if they are still processing my ITA when my work permit expires?

    Hi there!

    You have to make sure you hold a valid permit at all times, so if your permit runs out in September you will have to apply for a permit to be allowed to stay otherwise you will risk having your application declined.

    Work permit under partnership submitted 21/05/08 APPROVED 29/05/08
    Work permit extension under partnership submitted 06/03/09 APPROVED 23/03/09 Expires 23/03/10
    Residence permit under partnership submitted 06/03/09
    Immigration Officer assigned 30/04/09
    Residence Permit APPROVED 29/06/09
    Our Baby Boy is due 01/04/10 "whoopwhoop"

    As Kiaora says, you need to be covered by some kind of a permit until your residency is granted. If you still have the job that your work permits were granted for, it would be a good idea to go for another renewal. Failing that, you may be able to apply for a visit visa which will buy you up to 6 months depending on which country you are from and this might be extended. You wouldn't be able to work on this visa, of course. It depends on how many points you applied with as to how quickly your residency will be granted.

    Whatever you do, don't become an overstayer as that will go against you big time.
