Default worried sick

Hi I am a n.z citizen and married to a Canadian. My problem is my husband got into trouble in the states in his 20s with not providing a breath test while riding his motor bike. He was fined and spent a night in jail. He was released and went on with his travel. When he was returning to Canada after he visited me in n.z the immigration at the u.s.a airport questioned him while he was in transit. He was on his way home. He has worked with the same company for over 30 years and is very highly respected in his field of work. Do you see this as a problem to immigrate with me to n.z. My childern and my grandchilden are all in n.z. He has passed police rcmp criminal record. I hope to go back to n.z next year.

Hi Crystal.

I wouldn't worry to much, i'm sure he will be fine.

He hasn't commited any serious crimes and got a criminal record so i can't see there being any problems adn even more so the fact it was soooo long ago.

Hi Crystal and welcome.

If that offence was committed a long time ago he could plead 'folly of youth' i.e. something that was done out of youthful high spirits. If he has been 'clean' since then he shouldn't really have a problem. I think, if everyone who had done something stupid in their youth was banned from immigrating to NZ, the country would be half empty .

From reading between the lines on the EOI etc... I understand it is only offences where you have been convicted i.e. been to court for and normally only those that you have served a custodial sentence for. Being kept in a cell overnight for not providing a specimen is not the sort of crime they would be interested in. As other have said - it was so long ago and would be seen as being 'spent' so I wouldn't worry
