AVOCADO is on a distinguished road
Default Visitor's Visa to NZ

My boyfriend applied for but had his NZ working holiday visa cancelled in June 2004 with the advice that an alert would be placed against his name. (Cancellation based on non-disclosure of conviction even though it was declared on an initial application the same day, a stressful day in London, Naivity, foolishness, job change, mum seriously ill, nightmare day!) We therefore did not visit NZ as planned last year. However, close friends are to be married in Jan 2005 and we would like to go to NZ as tourists.
Does anyone know if you can enter NZ for a holiday even though we had a work hol visa cancelled? We were not told that we were excluded from NZ nor told that we are unable to enter NZ ever again. We have a cancelled visa in the passport and an Alert against his name. What does an alert mean?

We are trying to follow procedures & pre-empt matters as I have been offered a job in Sydney from Oct 04 on an intra-company transfer. My boyfriend applied in writing for and received a 48 tourist visa for Aus last week having provided 2 police checks detailing his minor conviction for a broken window in Dec 93. No problem. Will this NZ cancelled visa prove a problem when applying for 457 Au Visa or in retrospect the 48 tourist visa which we have just received? We have already applied for 136 and sent in passports etc which show the cancelled visa but he hasn't been excluded from any country so we didn't tick that box and I'm sure that DIMA can see the cancelled visa as it's the only stamp in his passport!
We are at our wits end and sick with worry as this is affecting the rest of our jobs and our future life together. Does anyone have any experience of this? Any advice? help!

Default Visitor's Visa to NZ

Hi Avocado,
Sorry for a delayed reply, your message got lost in a frenzy somewhere!

If your boyfriend has an alert against his name, it usualy means that when applying for anything in NZ again, you will be very thoroughly checked out. If it was litteraly a broken window (assuming its a criminal damage offence and there was no prison sentence etc?) then there shouldnt be any real problems, provided that this conviction is explicitly revealed on any applications. And be prepared for delayed processing times as immigration does the major once over on your past. If you were excluded from NZ, they would most certainly have said so.

Can't really advise you on the Aussie visas, so i'd recommend you take a visit to http://www.movetooz.org and post the question on the Australian visas on their forum.

All the best
