Default Permission for a Child to Live Overseas

We currently live overseas in France and I have recently received my divorce. My daughter is 9 and has no contact with her father, I never asked permission to take her to France but informed him of the move. I am not sure if he would willingly sign a letter giving me permission to take her to NZ (as he's a bit of an arse) , are the courts our only option in this case?
