Hi Suz,

Depends on just how long he's going to stall.... If you submit your EOI now, before he's signed, once you've received your ITA, you only have 4 months to submit it. If it becomes necessary to go to Court to get permission to bring the kids (i.e. if he doesn't voluntarily sign), then you could be looking at several months of Court proceedings, in which time your ITA might have expired.

We were in a similar situation where we had to get permission from the Court to bring my daughter, and the whole proceedings took approximtately 5/6 months. It may not take that long in your case, but the Courts are unfortunately renowned for taking their time and they won't be interested that you have a deadline for an ITA!

IMHO, I'd wait a while before you submit your EOI and see what happens with your ex - you never know, he might have a change of heart, then you can submit your EOI at your leisure!
